Febuary 20, Senator Schumer called for mandatory underide guards on tractor trailers. Underride guards are inexpensive side guards on trailers that prevent injury and save lives. Truck accident attorney John Feroleto has advocated for the simple safety guards to reduce necessary injuries in big rig crashes. Last month a western New York snowstorm resulted in […]
Trucking accidents are very different from car accidents. Different safety laws apply. There are very specific rules regarding safe operation and maintenance to prevent a truck crash. There are specific documents and evidence which should be secured to help win a case and fully compensate the injured party.
Our truck accident lawyers have years of experience handling these types of cases. John Feroleto served as the chair of the National Interstate Trucking Litigation Group of the American Association for Justice, a national group of the top truck accident lawyers in the United States dedicated to protecting the rights of those injured or killed in trucking accident cases. This experience directly contributes to the success our clients have in dealing with insurance and trucking companies after a devastating accident.

Statistics on Large Truck Crashes in New York
We pulled statistics from the New York Department of Motor Vehicles from 2011 to 2015 to find out how often these crashes occur on our roads. Our research found that, annually, there were:
- 11,436 crashes involving large trucks.
- Nearly 94 fatal crashes involving large trucks.
- Around 4,857 personal injuries in crashes involving large trucks.
When you consider the fact that an 18-wheeler can weigh more than 80,000 pounds and measure up to 75 feet in length, it’s not particularly surprising that truck versus car accidents typically result in more serious injuries and fatalities than other auto accidents. Each year, there are close to 4,000 fatalities in large truck crashes, with occupants of the smaller vehicle accounting for the majority of deaths. Victims who survive these terrible crashes often require extensive medical treatments which may continue for years, often leading to astronomical medical bills and the inability to return to work.
If you have suffered injury from a semi-truck accident, (neck injury, back injury, whiplash or other serious injuries) your medical bills are likely piling up at an alarming rate. The insurance company is probably giving you their very best runaround routine, and you are feeling frustrated and helpless as they make it difficult, if not impossible, to get the help and financial compensation you deserve.
Whether you were rear-ended by a truck, or suffered a hit-and run due to the actions of a negligent truck driver, an experienced personal injury lawyer familiar with big rig crashes can greatly improve the outcome of your accident claim. The attorneys of Feroleto Law are highly skilled in dealing with insurance companies and law suits involving complex federal safety rules that apply to interstate trucking accidents and many New York State tractor trailer crashes.
Common Causes of Trucking Accidents
In truck accidents where the trucker is found to be at fault, the cause is often due to driver fatigue. One study found that nearly one-third of truck drivers have mild to severe sleep apnea, a condition that greatly increases the chances of drowsy driving, distracted driving and inattention on the road. But there are many other causes of large truck crashes. Here are a few examples:
- Speeding or travelling too fast for conditions,
- Inexperienced drivers who did not receive adequate training,
- Truck drivers who drive under the influence,
- Truck drivers who drive too aggressively, changing lanes without proper care,
- Trucks that are overloaded or over-sized,
- Poorly maintained trucks, especially brakes and tires, and
- Inadequate or missing safety mechanisms
When Trucking Companies Fail on Safety
Many 18-wheeler accidents could have been prevented, whether they were due to the negligence or recklessness of the truck driver or from a large trucking company so caught up in their bottom line that they neglected the safety issues of their trucks. Truck drivers are working longer hours for less pay, and the demands of their employers too often create safety issues for the drivers and the other users of our roads. Thus, truck driving is a job fraught with fatigue.
A lack of proper training contributes to some truck crashes. Many truck driving companies show a three-minute video featuring the dangers of mixing drugs and truck driving. 180 seconds is simply not adequate to ensure these new, inexperienced drivers fully understand the consequences of mixing drugs with an 80,000-pound machine moving at high speeds, alongside cars traveling on New York State roads carrying drivers and their families.
Many trucking companies need to provide much better training for their drivers before they put them on the road. They should also have regular safety meetings and commit to ensuring that the safety features on every truck on the road are in good working order. If a trucking company or broker pushes the driver of an 18 wheeler or other big rig to make up time, it is a recipe for disaster. Unfortunately, this is a common cause of big rig crashes causing serious injuries to operators of cars on highways and thruways, such as the I-90.
The Aftermath of a Semi-Truck Accident
After a truck accident, you may experience catastrophic injuries resulting in incredible pain and suffering. If your injuries were caused by a reckless or negligent driver, you are entitled to compensation for your suffering. Damages in these types of cases include medical bills, property damage, lost income, loss of work capacity, permanent total disability or partial disability and other harms due to a serious injury.
The minimum insurance coverage required on big rigs is $750,000. Many companies have substantially more insurance coverage because of the amount of damage a commercial motor vehicle can cause. Insurance adjusters for these companies often try to take advantage of someone not familiar with the claims process or experience in handling truck wreck cases. This is where an experienced truck accident attorney is extremely valuable. Having the right attorney at your side will ensure that you are protected and that you will be well represented against the interests of large trucking companies and their insurance companies.
Truck Accident Safety Tips
The legal definition of a commercial truck is any vehicle that is transporting goods weighing 10,000 lbs. or more, which can include semis, tractor-trailers, and eighteen-wheelers. These types of trucks have a significant presence on highways across America, especially near states close to the Canadian border, like New York.
Due to the sheer size, weight and often-dangerous cargo of commercial trucks, truck accidents can be devastating for those involved. It isn’t unusual for truck accidents to cause severe injuries and fatalities, and usually it’s the passengers of the other vehicles who are killed. When this happens, it is critical that victims and their families hire experienced attorneys immediately to ensure their rights will be protected.
Common Causes of Truck Accidents
Truck accidents can be caused by a variety of factors, many of which constitute negligence in a court of law. Some common causes include fatigued or inexperienced drivers, equipment failure and not securing cargo appropriately.
If any of these scenarios take place, you should contact Feroleto Law immediately. We have decades of experience prosecuting truck accident lawsuits and have the dedication and skill necessary to build a successful case against the guilty party.
Depending on the situation, the party at fault could include:
- The truck driver
- The trucking company
- The truck maintenance company
- The company which loaded the truck
- The condition of the roads, signage, or lighting at the time
- Third party vehicles
To determine where negligence lies, our truck accident lawyer will coordinate a thorough investigation into the accident and then recommend the best course of legal action for you to take.
